Refund Policy

At signalthicket, we are committed to delivering high-quality digital services. Due to the nature of custom software development and digital service delivery, refunds are evaluated on a case-by-case basis in accordance with EU consumer protection regulations.

2. Eligibility for Refund

You may be eligible for a full or partial refund under the following circumstances:

  • Service Not Delivered: If the agreed service has not been initiated within the specified timeframe and no alternative arrangement has been made.
  • Material Defects: If the delivered service contains significant defects that render it unusable for its intended purpose and cannot be remedied within a reasonable timeframe.
  • Breach of Contract: If signalthicket fails to meet the agreed-upon specifications as documented in the service agreement.

3. Milestone-Based Refunds

For project-based engagements, payments are structured around milestones. Refunds for completed milestones are generally not available unless the delivered work materially deviates from the agreed specifications. Uncompleted milestone payments may be refunded in full, minus any administrative fees and work already executed up to the point of cancellation.

4. Cancellation by Client

If you wish to cancel a service engagement:

  • Before work has commenced: Full refund of any advance payments.
  • After work has commenced: Refund calculated based on percentage of completion and work delivered.
  • After delivery: No refund unless the service is materially defective.

5. Refund Request Process

To request a refund, contact us at [email protected] with the following information: your name, service agreement reference, reason for refund request, and supporting documentation. We will review your request and respond within 14 business days.

6. Processing Refunds

Approved refunds will be processed using the original payment method within 30 days of approval. For payments made via bank transfer, refunds will be sent to the originating account. Any applicable transaction fees are deducted from the refund amount.

Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by signalthicket, registered at Calle Ruda, 15, P01 C, 28005 Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Scope of Services

signalthicket provides digital development services including but not limited to: web development, system architecture, deployment automation, API integration, performance optimization, and technical consulting. The specific scope, deliverables, and timelines for each engagement are defined in individual service agreements.

3. Service Agreements

Each engagement is governed by a separate service agreement that defines: project scope and specifications, deliverables and acceptance criteria, payment terms and milestones, timelines and deadlines, intellectual property provisions. In the event of conflict between these Terms and a specific service agreement, the service agreement prevails.

4. Payment Terms

  • All prices are quoted in Euros (EUR) unless otherwise specified.
  • Payments are due according to the milestones defined in the service agreement.
  • Late payments may incur a fee of 1.5% per month on the outstanding balance.
  • Services may be suspended for accounts more than 30 days overdue.

5. Intellectual Property

Upon full payment, all intellectual property rights for custom-developed deliverables transfer to the client. signalthicket retains the right to use general knowledge, skills, techniques, and non-proprietary methods gained during the engagement. Pre-existing tools, frameworks, and libraries remain the property of their respective owners.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the service agreement for a period of 24 months.

7. Limitation of Liability

To the maximum extent permitted by applicable law, signalthicket's total aggregate liability for any claims arising from or related to the services shall not exceed the total fees paid by the client for the specific service giving rise to the claim. signalthicket shall not be liable for indirect, incidental, consequential, or punitive damages.

8. Warranty

signalthicket warrants that services will be performed in a professional and workmanlike manner consistent with industry standards. A 30-day warranty period applies to delivered code for defects in workmanship. This warranty does not cover issues arising from modifications made by the client or third parties.

9. Termination

Either party may terminate a service agreement with 14 days written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Pre-paid amounts for uncompleted work will be refunded.

10. Governing Law

These Terms of Service are governed by the laws of Spain and the European Union. Any disputes shall be resolved through good-faith negotiation, followed by mediation, and finally by the competent courts of Madrid, Spain.

11. Changes to Terms

signalthicket reserves the right to modify these Terms of Service at any material time. Changes will be communicated via email to active clients and posted on this page with an updated revision date.
